Article 12: Overtime
- Overtime is all time authorized by the Employer and worked by an Employee in excess of seven and three-quarter (7 3/4) hours per day or on scheduled days of rest.
- The overtime rate of two times (2X) the applicable basic hourly rate shall be paid for overtime worked:
- during all hours worked in excess of seven and three quarters (7 3/4) hours in a day; and
- for all hours worked on a scheduled day of rest.
- Where mutually agreed by the Employer and the Employee, the Employee may receive time off in lieu of overtime. Such time off shall be equivalent to the actual time worked adjusted by the applicable overtime rate and taken at a time mutually agreed by the Employer and the Employee.
- The Employer shall designate a manager at the care home or program who may authorize overtime. Authorization of overtime arising as a result of unforeseeable circumstances shall not be unreasonably denied by the Employer.
