Local Conditions Applicable to EMS

ARTICLE 51: EMPLOYEE STRANDING

  1. In the event circumstances prevent an Employee’s return to their place of employment, the following principles shall be observed in determining compensation:

    1. An Employee shall suffer no loss of earnings.

    2. An Employee shall be reimbursed for reasonable and substantiated expenses.

    3. Work shall be considered complete at the end of the regularly scheduled shift or when the Employee reaches their overnight accommodation Site if overtime has occurred (whichever is later), and a new shift at regular rates of pay begins at the time of departure from the accommodation Site.

    4. Where an Employee is unable to return to their regular work Site on a regularly scheduled day of rest, they will receive overtime payment in accordance with Article 12 for the length of their shift.

    5. For international Air Medivacs only, an Employee may waive premium payment under Articles 10.09(b)(ii) or 44.03 (10.09(b)(ii) by mutual agreement between Employer and Employee.

An Employee is required to make arrangements that will minimize the time spent in travel.
