Article 39: Part-Time, Temporary and Casual Employees

Temporary Employees

  1. A temporary full-time or temporary part-time Employee shall be covered by the applicable provisions of this Collective Agreement except:
    1. Article 20 (Employee Benefit Plan), unless employed in a temporary position of twelve (12) months or more and after the completion of six (6) months of continuous service.
    2. Article 23 (Promotions, Transfers and Vacancies). During the term of a temporary position, an Employee shall be eligible to apply on postings in accordance with the following:
      1. Such Employees shall be eligible to apply on postings of vacancies for regular positions pursuant to Article 23.01.  In the event that such Employee is successful on a posting pursuant to Article 23.01, the Employer shall not be required to post any resulting vacancy of less than three (3) months.
      2. Where a vacancy for a temporary position exists, such Employee shall not be eligible to apply, unless the position posted commences after the expiry of the term for which they were hired.
    3. Article 24 (Layoff and Recall).

    1. A Temporary Employee shall not have the right to grieve the termination of the temporary position.
    2. The Employer shall provide at least seven (7) calendar days written notice of termination of their temporary position.
    3. A regular Employee occupying a temporary position shall retain their seniority and shall not have the right to grieve placement pursuant to Article 23 when no longer required in that capacity.

    Part-time Employees
    Except as modified by this Article, all provisions of this Collective Agreement shall apply to part-time Employees.

  3. Part-time Employees shall be paid, in addition to their regular salary, five percent (5%) of their earnings in lieu of Named Holidays.
  4. A part-time Employee required to work on a Named Holiday shall be paid at one and one half times (1 1/2X) their basic rate of pay for work performed on a Named Holiday.
  5. A part-time Employee shall accumulate sick leave credits on the basis of one and one-half (1 1/2) days per month, pro-rated on the basis of the regularly scheduled hours worked by the part-time Employee in relation to the regularly scheduled hours for a full-time Employee.
  6. The basic rate of pay will prevail for additional hours worked by a regular part-time Employee beyond their scheduled hours provided the hours worked do not exceed the thresholds outlined in Article 11: Overtime.

    Casual Employees

  7. Except as modified in this Article, all provisions of this Collective Agreement shall apply to Casual Employees except that Articles 8,10, 18, 20, 21, 22, 24, 28, 30, and 33 have no application to Casual Employees.
  8. Casual Employees shall be paid, in addition to their regular salary, five percent (5%) of their earnings in lieu of Named Holidays.
  9. Casual Employees required to work on a Named Holiday shall be paid at one and one-half times (1 1/2X) their basic rate of pay for work performed on a Named Holiday.
