Article 5: Non-Discrimination, Harassment or Bullying
- The Employer, Union, and Employees are committed to having a safe and respectful workplace where discrimination, harassment and violence are not tolerated.
- There shall be no discrimination or harassment practiced by either party in respect of an Employee by reason of political affiliation, race, religious beliefs, colour, gender, gender identity, gender expression, physical disability, mental disability, age, ancestry, place of origin, marital status, source of income, family status, or sexual orientation, nor by reason of membership or non-membership or lawful activity in the Union, nor in respect of an Employee or Employer exercising any right conferred under this Agreement or any law of Alberta, as per the Employer’s Policy. The terms in this Article shall be interpreted in a manner consistent with the Alberta Human Rights Act.
- Article 5.02 does not apply with respect to a refusal, limitation, specification or preference based on a bona fide occupational requirement.
