Article 22: Job Classifications

  1. New Classifications
    If the Employer creates a new classification within the scope of the bargaining unit, or if an existing classification is added to the bargaining unit, the following shall apply:
    1. The Employer shall provide written notice to the Union of the classification title and proposed pay rates for the classification within thirty (30) days.
    2. If the Union does not agree with the proposed pay rates, the parties shall, within thirty (30) days of the creation or inclusion of the classification, meet and attempt to agree upon a pay scale for the implementation of the classification.
    3. If the parties are unable to agree upon a pay scale, the Union may refer the matter to mediation/arbitration as per Article 8.
    4. During the conduct of the processes described above, the Employer may establish an interim rate of pay and fill positions within the classification pending the outcome of the processes, on the understanding that the ultimate pay rate shall be retroactive to the date of creation of the classification.
  2. Position Classification Review
    1. An Employee who feels their position is improperly classified may apply to the G.M. to have the classification reviewed.
      1. The G.M.’s decision shall be rendered within thirty (30) days of the request.
      2. An Employee who initiates a request under this clause is entitled to the assistance of a Union Representative and shall have access to the grievance and Arbitration procedure.
      3. Where the review concerns an Employer-initiated downgrading of classification, the affected Employee may appeal the G.M.’s decision within thirty (30) days through the Grievance Procedure, including Arbitration, if necessary.
  3. Employees who are placed in a lower paid classification by the Employer as a result of a classification being eliminated, shall be red-circled until such time as the rate of pay in the new classification meets or exceeds the Employee’s red circled rate.
