Article 37: Temporary Employees

  1. Application
    1. Except as specifically provided hereinafter, the provisions of this Collective Agreement shall not apply to Temporary Employees.
    2. The provisions of Articles:

      shall apply to Temporary Employees. 
       
  2. Named Holidays
    1. Temporary Employees required to work on a Named Holiday shall be paid at:
      1. one and one-half times (1 1/2X) their Basic Rate of Pay for work performed up to seven and three-quarter (7 3/4) hours;
      2. two and one-half times (2 1/2X) their Basic Rate of Pay for all overtime hours worked.
    2. A Temporary Employee required to work on the August Civic Holiday and Christmas Day shall be paid at:
      1. two times (2X) their Basic Rate of Pay for work performed up to seven and three-quarter (7 3/4) hours;
      2. three times (3X) their Basic Rate of Pay for all overtime hours worked.
    3. Temporary Employees shall be paid five percent (5%) of their earnings at the Basic Rate of Pay and of their vacation pay in lieu of Named Holidays.
  3. Employee Benefits
    Temporary Employees, except as provided in Article 26.05 and Article 26.06, are not entitled to participate in the Health Benefits Plan.
  4. Pension Plan
    The Employer shall contribute to the Local Authorities Pension Plan for retirement benefits for eligible participating Temporary Employees who request enrolment in the Plan in accordance with the regulations of the Plan.
  5. Bereavement Leave
    1. Temporary Employees with less than six (6) months continuous employment will be entitled to time off without pay in lieu of bereavement leave pursuant to Article 30 of this Collective Agreement.
    2. Temporary Employees with six (6) months or more of continuous employment will be entitled to time off with pay for bereavement leave pursuant to Article 30 of this Collective Agreement.
  6. Change of Status
    1. A Temporary Employee who transfers to Regular full-time or Regular part-time employment with the Employer shall be credited with the following entitlements earned during their period of employment:
      1. salary increments;
      2. vacation entitlement; and
      3. seniority in accordance with Article 34.
    2. A Temporary Employee shall also be credited with sick leave earned and not taken during their period of temporary employment.
