Article 3: Management Rights
- The Employer reserves all rights not specifically restricted or abrogated by the provisions of this Collective Agreement.
- Without limiting the generality of the foregoing, the Employees acknowledge that it shall be the exclusive right of the Employer to operate and manage its business, including the right to:
- maintain order, discipline and efficiency;
- make, alter, and enforce, from time to time, rules and regulations to be observed by an Employee which are not in conflict with any provision of this Collective Agreement;
- direct the working force and to create new classifications and work units and to determine the number of Employees, if any, needed from time to time in any work unit or classification and to determine whether or not a position, work unit, or classification will be continued or declared redundant,
- hire, promote, transfer, layoff and recall,
- demote, discipline, suspend or discharge for just cause.
- The Employer will provide to the Union all policies and procedures, as well as all departmental guidelines affecting employees which are related to employment matters.
Where the Employer’s policies and procedures are maintained only in a hard copy format, the Employer will place the Union on a distribution list and ensure that as amendments are approved, or as new policies and procedures are approved, they are forwarded to the Union. Where the Employer policies and procedures are maintained electronically, the Employer will e-mail a copy to the Union.
