Article 35: Court Appearance

- An Employee required by law to appear in court as a witness, as a direct result of their regular duties, or as a juror or for juror selection shall not receive any loss in earnings from the Employer. The Employee shall sign over to the Employer, on the proper forms, any and all monies paid to them from the courts for witness duty.
- It is agreed that when an Employee is subpoenaed as a witness as a direct result of their regular duties, is called for jury selection, or becomes a juror, they shall not suffer any loss of pay while so serving when the witness duty coincides with a regularly scheduled on-duty shift. Should an Employee be required to serve as a witness in any case arising as a result of their regular duties on their scheduled day(s) off, they shall be paid in accordance with the provisions of Article 12.01.

- In the event that an Employee is scheduled to work on a night shift before or after a day that they are called as a witness in matters arising as a direct result of their regular duties with the Employer, or as a juror, they shall be granted a leave of absence without pay for a period of six (6) hours on the night shift immediately prior to, or immediately after, each court appearance day. Should the Employee’s required court time each day exceed the six (6) hours’ leave of absence provided, the difference shall be paid to the Employee according to other provisions of the Collective Agreement.
- No Employee shall suffer a loss in regular earnings for a court appearance, regardless of the amount of time required to be in court.
- Where an Employee is required by law to appear before a court of law for reasons other than those stated above, they shall be granted a leave of absence without pay.
