Article 12: Overtime
- Overtime is all time authorized by the Employer and worked by an Employee in excess of seven and three-quarter (7 ¾) hours per day or their regularly scheduled shift (whichever is greater) or on scheduled days of rest. Overtime will be paid at one and a half times (1.5X) their basic rate of pay.
- The Employer shall designate an individual who may authorize overtime.
- Authorization for overtime after the fact by the Employer shall not be unreasonably denied where overtime arises as a result of unforeseeable circumstances in which it is impossible to obtain prior authorization.
- Overtime will be paid in accordance with the following:
- For work in excess of seven and three-quarter (7 ¾) hours per day or their regularly scheduled shift (whichever is greater), one and a half times (1.5X) their basic rate of pay.
- This overtime payment will cease, and the Employee’s basic rate of pay will apply at the start of the next regularly scheduled shift.
- For work on scheduled day(s) of rest, one and a half times (1.5X) their basic rate of pay. This overtime payment will cease, and the Employee’s basic rate of pay will apply at the start of their next regularly scheduled shift.
- Subject to mutual agreement between the Employer and an Employee, the Employee may be granted time off duty in lieu of overtime payments on an hour-for-hour basis, at the basic rate of pay. Unless mutual agreement between an Employee and the Employer is reached as to when accumulated overtime will be taken as time off in lieu or overtime payment, such liability of the Employer shall be paid out as of March 31st. Such payment will occur in the first pay period following March 31st.
- Except in cases of emergency, no Employee shall be required or permitted to work more than a total of sixteen (16) hours (inclusive of regular and overtime hours) in a twenty-four (24) hour period beginning at the first (1st) hour the Employee reports for work.
- Rest periods and meal periods shall be provided in accordance with the Hours of Work Article of the Collective Agreement.
- Employees shall not be required to layoff during their regularly scheduled shifts to equalize any overtime worked previously.
