Article 12: Overtime
- Overtime is all time authorized by the Employer and worked by an Employee in excess of eight (8) hours per day or on scheduled days of rest.
- The Employer shall designate an individual who may authorize overtime.
- Authorization for overtime after the fact by the Employer shall not be unreasonably denied where overtime arises as a result of unforeseeable circumstances in which it is impossible to obtain prior authorization.
- Overtime will be paid in accordance with the following:
- For work in excess of eight (8) hours per day, one point five times (l.5X) their basic rate of pay, exclusive of meal periods, if taken. This overtime payment will cease and the Employee’s basic rate of pay will apply at the start of the next regularly scheduled shift.
- For work on scheduled day(s) of rest, one point five times (l.5X) their basic rate of pay. This overtime payment will cease and the Employee’s basic rate of pay will apply at the start of their next scheduled shift.
- An Employee who normally returns to their place of residence by means of public transportation following the completion of their regularly scheduled shift, but who is prevented from doing so by being required to remain on duty longer than such shift and past the time when normal public transportation is available, shall be reimbursed for the cost of reasonable, necessary and substantiated transportation expense to their place of residence.
- Subject to mutual agreement between the Employer and an Employee, the Employee may be granted time off duty in lieu of overtime payments at the applicable premium rate. Unless mutual agreement between an Employee and the Employer is reached as to when accumulated overtime will be taken as time off in lieu of overtime payment, such liability of the Employer as of the last day of June, shall be paid out.
- Except in cases of emergency, no Employee shall be required or permitted to work more than a total of sixteen (16) hours (inclusive of regular and overtime hours) in a twenty-four (24) hour period beginning at the first (1st) hour the Employee reports for work.
- Rest periods and meal periods shall be provided in accordance with Article 10.02.
