Article 3: Management Rights

  1. The Employer reserves all rights not specifically restricted or abrogated by the provisions of this Collective Agreement.
  2. Without limiting the generality of the foregoing, the Union acknowledges that it shall be the exclusive right of the Employer to operate and manage its business, including the right to:
    1. maintain order, discipline and efficiency;
    2. make, alter, and enforce, from time to time, rules and regulations to be observed by an Employee which are not in conflict with any provisions of this Collective Agreement;
    3. direct the working force and to create new classifications and house/work units and to determine the number of Employees, if any, needed from time to time in any house/work unit or classification and to determine whether or not a position, house/work unit, or classification will be continued or declared redundant;
    4. hire, promote, transfer, layoff and recall;
    5. demote, discipline, suspend or discharge for just cause.
