Christenson Communities Ltd. Bargaining Update #7

The Alberta Labour Relations Board has issued its decision and agreed with both the employer and HSAA that implementing an Essential Services Agreement at this stage would substantially interfere with meaningful bargaining. For that reason, the Board has refused to accept the Essential Services Agreement for filing.

The Board also stated that, if the parties are unable to reach a collective agreement, the dispute will be resolved through compulsory arbitration under section 95.44(7) of the Labour Relations Code.

The next step under section 65 of the Labour Relations Code is formal mediation. Only after formal mediation has taken place can the parties proceed to binding arbitration.

What happens next

HSAA will be applying for a mediator and working to secure dates to resume bargaining as soon as possible. We will continue to keep members updated as the process moves forward.
